These Terms of Use are a legal agreement between you and Pose Arcade (doing business as BarSpeed). By downloading, accessing, or using the BarSpeed applications or website you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use BarSpeed.
You must be at least 13 years old to create a BarSpeed account. If you are between 13 and 18 years old, a parent or guardian must review these Terms with you. Account credentials must be kept secure. You are responsible for all activity that occurs under your login, whether authorized or not.
We grant you a limited, non-transferable, revocable license to install and use BarSpeed on Apple devices you own or control for personal training or coaching purposes. You may not copy, resell, reverse engineer, decompile, or attempt to extract the source code of BarSpeed except to the extent permitted by applicable law.
Access to BarSpeed Premium requires an active subscription processed through Apple's App Store. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. To manage or cancel your plan, visit your Apple ID settings. Refund requests are handled by Apple in accordance with their policies.
BarSpeed provides metrics and insights to inform training decisions, but it is not a medical device. Consult qualified coaches or healthcare professionals before beginning any new exercise program. Warm up properly, use appropriate equipment, and follow safe lifting practices. You assume all risks associated with strength training activities.
You retain ownership of the data and media you record in BarSpeed. By submitting content, you grant us a limited license to process and display that content solely to operate and improve the service. You are responsible for ensuring that any shared highlights or exports comply with applicable laws and do not infringe the rights of others.
BarSpeed, the Pose Arcade name, logos, software, and related content are protected by intellectual property laws and remain the exclusive property of Pose Arcade. Unauthorized use of our marks or materials is prohibited without written permission.
BarSpeed integrates with Apple, Firebase, RevenueCat, and other third-party services. Your use of those services is subject to their respective terms. We are not responsible for third-party content or practices.
We may suspend or terminate your access to BarSpeed at any time if we believe you have violated these Terms, misused the service, or created a security risk. You may stop using BarSpeed at any time and can request account deletion by contacting support.
BarSpeed is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that metrics will be accurate for every rep or that training outcomes will improve.
To the fullest extent permitted by law, Pose Arcade and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of BarSpeed. Our total liability for any claim relating to BarSpeed is limited to the amount you paid for the service in the twelve months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Pose Arcade, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses arising out of your use of BarSpeed or violation of these Terms.
We may update these Terms to reflect product improvements or legal requirements. If changes are material, we will provide notice through the app or email. Continued use of BarSpeed after the effective date of an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, excluding its conflict of law principles. You and Pose Arcade agree to submit to the personal jurisdiction and venue of the state and federal courts located in San Francisco County, California.
